Terms of Service

1. Acceptance of terms

By accessing or using the Yoluko website at yoluko.com and any associated services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services. These Terms constitute a binding agreement between you and Alexandre Kocev, micro-entrepreneur registered in France, operating as Yoluko.

2. Service description

Yoluko provides healthcare market intelligence by detecting and cataloguing technology usage across clinic websites in Australia and the United Kingdom. Our Services include data feeds, CSV exports, Google Sheets reports, and API access to structured clinic and technology data. We also offer free tools including clinic profile pages and a clinic lookup widget.

3. Data accuracy

Our data is derived from publicly available sources using automated detection methods. While we take reasonable steps to ensure accuracy and refresh data weekly, we do not guarantee that our data is 100% accurate, complete, or current. Specifically:

  • Technology detection is best-effort and based on publicly visible signals (HTML, JavaScript, HTTP headers, DNS records).
  • Clinics may use technologies that are not detectable through public website analysis.
  • Business information (names, addresses, team sizes) is sourced from Google Maps listings and public web pages, which may be outdated.
  • Contact information is collected from publicly listed sources and is not independently verified unless explicitly stated.

You are responsible for verifying data accuracy for your specific use case before making business decisions based on our data.

4. Permitted use

You may use our Services and data for lawful business purposes, including:

  • Sales prospecting and lead qualification.
  • Market research and competitive analysis.
  • Business intelligence and reporting.
  • Investment research and due diligence.

You may not resell, redistribute, or sublicense our raw data to third parties without prior written consent. You may not use our data for spam, harassment, or any activity that violates applicable privacy or anti-spam laws.

5. Intellectual property

All content on yoluko.com, including text, graphics, logos, data structures, detection methodologies, and software, is the property of Yoluko and protected by applicable intellectual property laws. Our detection logic, attribution algorithms, and data pipeline architecture are proprietary. A paid subscription grants you a limited, non-exclusive licence to use the data for your internal business purposes only.

6. Payment and billing

Paid services are billed as agreed in individual client agreements. Payments are processed through Stripe. All prices are in EUR unless otherwise specified. Invoices are issued by Alexandre Kocev, micro-entrepreneur (auto-entrepreneur), VAT exempt under article 293B du CGI. Refund terms are specified in individual client agreements.

7. Limitation of liability

To the maximum extent permitted by law, Yoluko shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services or data. This includes, without limitation, damages for loss of profits, data, business opportunities, or goodwill. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your access to our Services at any time, with or without cause, upon reasonable notice. You may stop using our Services at any time. Upon termination, your right to access paid data feeds and exports ends immediately. Data already delivered to you remains subject to the permitted use restrictions in Section 4.

9. Governing law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lyon, France.

10. Changes to these terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "last updated" date. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
